Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and CaptionTik (“CaptionTik”, “we”, “us”, “our”), the operator of the website captiontik.cyou, the CaptionTik caption editor and the related APIs (together, the “Service”). By creating an account, purchasing a plan or credits, or otherwise using the Service, you agree to these Terms, our Privacy Policy and our Refund & Cancellation Policy. If you do not agree, please do not use the Service.

1. The Service

CaptionTik is an online software service for creating animated, word-timed captions for videos. You can transcribe a video, style captions with templates, and export a captioned video or subtitle files. Most processing runs inside your web browser on your own device. Optional cloud features (cloud project sync, cloud transcription, AI styling and the Automation API) process data on our servers or those of our service providers. CaptionTik is a digital service; nothing is shipped physically (see our Shipping & Delivery Policy).

2. Eligibility and accounts

  • You must be at least 18 years old, or the age of majority where you live, and competent to contract under the Indian Contract Act, 1872. If you use the Service for a business, you confirm you are authorised to bind that business.
  • Provide accurate information and keep it up to date. Keep your password and API keys confidential; you are responsible for all activity under your account and keys.
  • Tell us promptly at support@captiontik.cyou if you suspect unauthorised use of your account.

3. Plans, prices and payment

  • The Service has a Free plan, paid subscription plans (billed monthly or yearly) and one-time credit packs. Current prices and what each plan includes are shown on our pricing page. Prices are in Indian Rupees (INR) and include applicable taxes unless stated otherwise at checkout.
  • Payments are processed by Razorpay Software Private Limited using UPI, cards, net banking, wallets or other methods it supports. We never see or store your full card number, CVV or UPI PIN.
  • Subscriptions are charged in advance at the start of each billing period and renew automatically, using the payment mandate you authorised, until you cancel.
  • Plan usage limits (such as export minutes, transcription minutes, AI runs and API minutes) reset at the start of each calendar month and unused allowance does not carry over. Credits from credit packs are used after your monthly allowance and do not expire at the end of the month.
  • We may change prices for future billing periods. We will tell you by email or in the app at least 7 days before a price change applies to your subscription; you can cancel before it takes effect.
  • If a payment fails, we may retry it and may move your account to the Free plan until payment succeeds.

4. Delivery and activation

Paid plans and credits are activated on your account automatically as soon as Razorpay confirms your payment, usually within a few seconds. If your payment succeeded but your plan or credits are not active within 30 minutes, contact us with your payment ID and we will activate them or refund you.

5. Cancellation of subscriptions

  • You can cancel a subscription at any time from Dashboard → Billing, or by emailing us from your account email address.
  • Cancellation stops all future renewals. You keep paid features until the end of the billing period you have already paid for; after that your account moves to the Free plan. Your projects are not deleted.
  • Upgrades take effect immediately. Downgrades take effect at the end of the current billing period.
  • Refunds, where applicable, are handled under our Refund & Cancellation Policy.

6. Your content

You keep all rights in the videos, audio, transcripts and captions you create or upload (“Your Content”). You grant us a limited, non-exclusive licence to host, process and transmit Your Content only as needed to provide the Service to you. You confirm that you own or have the necessary rights to Your Content and that it does not infringe anyone’s rights or break any law.

7. Acceptable use

You agree not to use the Service to:

  • create, upload or share content that is unlawful, infringing, defamatory, obscene, sexually exploitative (including any content involving minors), hateful, or that threatens the unity, integrity or security of India, or is otherwise prohibited under the Information Technology Act, 2000 and the rules made under it;
  • impersonate anyone, mislead others, or distribute malware or spam;
  • probe, attack, overload or interfere with our systems, or bypass usage limits or security controls;
  • copy, resell, sublicense or reverse engineer the Service, except as the law expressly allows.

We may remove content or suspend accounts that break these rules, and we cooperate with lawful requests from authorities.

8. Third-party services and your own API keys

Some features use third-party providers (for example speech-to-text or AI language models). If you add your own provider API key, your use of that provider is governed by its terms and any charges it makes are between you and the provider. We are not responsible for third-party services.

9. Intellectual property

The Service, including its software, templates, design and the CaptionTik name and logo, is owned by us or our licensors and protected by law. Captions and videos you export using our templates are yours to use, including commercially. Open-source components are used under their licences, listed on our open-source licences page.

10. Availability and changes

We work to keep the Service available and secure but do not guarantee it will be uninterrupted or error-free. We may add, change or remove features. If we make a material change that reduces a paid feature you rely on, we will give reasonable notice and, where appropriate, a pro-rata refund of the unused period.

11. Disclaimers and limitation of liability

The Service is provided on an “as is” and “as available” basis. Automatic transcription and AI styling can make mistakes; please review captions before you publish them. To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, or for loss of data you did not back up. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the event giving rise to the claim. Nothing in these Terms limits rights you have under the Consumer Protection Act, 2019 that cannot be limited by contract.

12. Indemnity

You agree to indemnify us against claims, losses and costs arising from Your Content or your breach of these Terms or of any law.

13. Suspension and termination

You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination (including 6, 9, 11, 12 and 15) will survive.

14. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page with a new “Last updated” date and, for material changes, notify you by email or in the app. Continued use after the change means you accept it.

15. Governing law and disputes

These Terms are governed by the laws of India. Before going to court, please contact us so we can try to resolve the issue informally within 30 days. Subject to that and to any rights you have under consumer protection law to approach a consumer commission, the competent courts at the place of our registered office in India have exclusive jurisdiction.

16. Grievance Officer

In accordance with the Information Technology Act, 2000, the rules made under it and the Consumer Protection (E-Commerce) Rules, 2020, complaints about the Service or content on it can be sent to our Grievance Officer: Grievance Officer, CaptionTik, CaptionTik, India, email support@captiontik.cyou. We acknowledge complaints within 48 hours and aim to resolve them within 30 days.
